Bettendorf man sentenced in Walmart intercourse assault case

DAVENPORT, Iowa (KWQC) – A Bettendorfer who forcibly grabbed and fondled a woman at a Walmart in Davenport in October was sentenced to a maximum of two years in prison in the Iowa Department of Justice for sexual abuse.

Records in the Scott County Courthouse show that 20-year-old Damian McMahill pleaded guilty back in March of sexually assaulting him over the incident.

During his Wednesday afternoon trial, the state proposed allowing McMahill to serve the length of his prison sentence, 10 years probation, on probation and in an inpatient correctional facility (RCF).

However, based on McMahill’s story, the judge turned the proposal down and ordered him to be detained in the Iowa Department of Justice for a maximum of two years. In addition, the judge ordered McMahill to pay a fine of up to $ 855 and a sexual abuse fee of $ 90.

McMahill must also give the state a DNA sample and register as a lifelong sex offender.

In addition, McMahill receives a special suspended sentence of up to 10 years upon completion of his incarceration.
