CONCORD, NH (AP) – The New Hampshire Supreme Court has expanded the definition of adultery to include same-sex infidelity.

The court ruled Thursday in the case of a man who filed for divorce on charges of adultery because his wife was having an affair with another woman. A lower court rejected his petition based on a 2003 Supreme Court opinion that limited the definition of adultery to intercourse between people of the opposite sex.

However, the Supreme Court overturned its previous ruling, saying the old definition contradicts same-sex marriage enactment by lawmakers in 2009.

“It goes against logic to suggest that our lawmakers and the Supreme Court recognized the right of same-sex couples to have legal marriages without also intending that same-sex couples be given all the responsibilities, safeguards and grounds for divorce with the legal status of marriage connected, ”wrote the judges unanimously.

The divorce case in question has been sent back to the lower court for further processing.
